Malcolm McPherson Prevails at Trial in Atlantic County and in Appellate Division
Malcolm recently prevailed in a jury trial in Atlantic County for personal injuries. The trial was held on November 26, 2018 through December 3, 2018. The plaintiff claimed an aggravation of prior injuries to her spine as a result of a motor vehicle accident. Malcolm successfully defended the claim and the jury returned a unanimous verdict finding the Plaintiff did not sustain a permanent injury as a result of the subject accident.
Malcolm McPherson prevailed in a matter involving an appeal to the New Jersey Superior Court Appellate Division. Plaintiff filed suit claiming serious injuries arising out of a motorcycle accident. Plaintiff sought underinsured motorist (“UIM”) coverage under a policy which provided liability and UIM coverage for operation of his pickup truck and other four-wheeled vehicles. Malcolm successfully had the matter dismissed by way of summary judgment motion at the trial level. Plaintiff appealed, claiming that the relevant policy language was ambiguous and unclear. The Appellate Division affirmed the trial court in an unpublished opinion, finding that the dismissal was warranted given the clear language of the policy and the sound reasoning of the trial court.
