Malcolm I. McPherson Wins Trial by Directed Verdict
The trial was before the Hon. Joseph L. Marczyk, P.J. Cv. on February 12, 2018 through February 13, 2018. Plaintiff claimed that he sustained permanent injuries to his low back as a result of a motor vehicle accident that occurred on June 26, 2007. Plaintiff called Dr. Andrew Glass (Neurosurgeon) as his expert at trial. The case involved a claim of aggravation of pre-existing injury/disability and contested liability. Upon consideration of Defendant’s motion for directed verdict, the court found that Plaintiff’s claim of aggravation of pre-existing injury/disability was not supported by the required medical proofs. Directed verdict was entered in favor of Defendant.
