Hoagland Longo Prevails in $2 Million Complex Construction Defect Case on Behalf of Jersey Devils, LLC
Hoagland Longo Partners Michael F. Dolan and Peter K. Oliver recently prevailed in a $2 million multi-party complex construction defect case on behalf of Jersey Devils, LLC, an installation company based in Atlantic County that constructed a bulkhead for the Plaintiff’s condominium association.
Following a request for a Rule 104 Hearing, granted by the Superior Court of Atlantic County, the Hoagland Longo team challenged the methodology used by Plaintiff’s expert to calculate damages. The Court found the expert’s methodology was not supported by the evidence, deeming the expert’s opinion to be a “net opinion” and insufficient to allow the case to proceed. The Court then granted the defense motion for summary judgment dismissing all claims.
