Frank Kontely Wins at Trial

On January 16, 2014, Frank Kontely completed a successful liability jury trial before Judge Jane Cantor in the Superior Court of Middlesex County.  The case arose out of a motor vehicle accident in the westbound lanes of the New Jersey Turnpike Extension in January 2009.  Three plaintiffs – one driver and two passengers – claimed that our client, the defendant truck driver, was completely responsible for the accident.  Plaintiffs had demanded $3 million to settle their personal injury lawsuits.  At trial, the jury rendered a verdict in favor of our client/defendant, accepting his version that the impact occurred in his lane of travel and finding the plaintiff driver 70 percent at fault for the accident.  The result is that the plaintiff driver is precluded from recovering any damages and the passenger plaintiffs are limited to recovering only 30 percent of their provable damages in a future trial.
