Frank Kontely Secures Summary Judgment in Personal Injury Action

Frank Kontely obtained summary judgment in a personal-injury action against the firm’s client, a commercial property owner/landlord.  The case was venued in the Superior Court of New Jersey – Ocean County.  Plaintiff alleged personal injuries due to a fall on the premises.  Frank moved for summary judgment against one the flagship tenant, arguing that our client was not liable and was owed defense and contractual indemnification from the tenant.  Judge Craig Wellerson granted our motion for summary judgment and awarded our client’s costs and fees incurred because of the tenant’s refusal to voluntarily assume our client’s defense.
