Frank Kontely Prevails in Construction Site Accident Trial
On June 16, 2017, Frank Kontely completed a successful liability jury trial before Judge Christine Vanek in the Superior Court of Hudson County. The case arose out of plaintiff’s fall during construction work on the Pulaski Skyway. Our client was a developer/general contractor that was overseeing bridge repairs. Plaintiff was an employee of a subcontractor that fell from a trailer while unloading materials. Prior to trial, plaintiff demanded $3 million to settle his lawsuit.
At trial, plaintiff presented expert testimony that our client was responsible for hazards on the worksite. Plaintiff submitted evidence of over $800,000 in medical bills and lost income, and he claimed permanent injuries. Plaintiff claimed that he was physically unable to return to work due to his personal injuries.
After a two-week trial, the jury rendered a verdict in which it found that our client was not responsible for the alleged incident. Therefore, the jury awarded plaintiff no monetary damages.
