Frank Kontely Obtains Summary Judgment in Personal Injury Case on Behalf of NJ Property Developer
Frank Kontely obtained summary judgment in a personal-injury action against his client, a successful New Jersey property developer. In this matter, venued in the Superior Court of New Jersey – Essex County, plaintiff claimed to have sustained severe personal injuries when he fell from a scaffold that was erected by one of the client’s subcontractors. Frank tried to resolve the case through mediation, but plaintiff demanded over $2 million to settle the case. Therefore, Frank moved for summary judgment – arguing that plaintiff’s expert’s opinion was a net opinion inasmuch as plaintiff’s own testimony contracted it. Judge Stephen Petrillo granted the motion for summary judgment, finding insufficient evidence to prove liability against our client.
