I’m Interviewing Attorneys for My Divorce Case—What Questions Should I Ask?
When you make the decision to file for divorce in New Jersey or need representation after your spouse has filed for divorce, finding the right attorney can feel like a daunting process. While you may have a friend or a family member who recently got divorced and can recommend a family law attorney for your case, it is still extremely important to arrange initial consultations to find the lawyer you want to represent you. Your divorce will likely be one of the most difficult experiences you will have, and as such it is essential to work with an attorney you trust. Different family law attorneys have distinct specialties and particular ways of working, so you should always interview a lawyer before hiring them to work on your case.
When you do meet with a lawyer, what questions should you ask? Some of the following questions can help you discern whether you will be hiring the divorce attorney who is best for your case and particular situation.
1. How Long Have You Been Practicing Divorce Law?
It is extremely important to have a family law attorney on your side who has experience handling divorce cases under New Jersey divorce law (New Jersey Rev. Stat. § 2A:34-10). Any lawyer you consider hiring should be able to tell you how long they have been practicing and to describe their experience on different divorce matters.
2. Have You Taken Cases with Issues Similar to Mine?
While many divorce cases have similarities, each case comes with its own facts and circumstances. Although a divorce attorney may not have experience handling a case with the exact fact patterns as your case, it is nonetheless important to work with a lawyer who has experience handling cases similar to yours.
3. How Will We Be in Touch if I Hire You For My Divorce Case?
Will you be able to call your attorney when you have questions? Can you send text messages or emails? Asking questions about communication is extremely important. You will want to know up front how your attorney communicates with clients and how frequently you can expect communication.
4. How Do You Handle Payments and Fees?
You should ask a divorce attorney about how she or he handles fees and payments, and what your options are for paying your bill. You should also inquire about the total likely cost for your divorce case so that you can plan ahead. The best divorce lawyers will be able to talk to you honestly about ways to keep costs down while also being realistic about the time commitment necessary for your divorce.
