Daniel R. Kuszmerski is a partner in the firm’s Environmental and Toxic Tort Litigation Department, focusing on environmental law.  He has extensive experience in prosecuting and defending talc, asbestos, mold, home heating oil, carbon monoxide, benzene, silica, and natural disaster claims venued in both state (NJ, PA, & NY) and federal court.  In this capacity, Dan represents individuals, small businesses, multinational corporations, and insurance carriers.

Dan also handles a broad range of general liability matters, including product liability claims; auto accidents; slip and falls; premises liability; lemon law; consumer fraud claims; and collection matters. He is experienced in all stages of litigation, from inception through trial and is regularly called upon to argue motions, defend and conduct depositions and oversee settlement negotiations.  Dan often appears for arbitrations and mediations wherein he draws upon his years of experience to gain favorable results for his clients.

Additionally, Dan is versed in appellate matters.  Dan successfully participated in the case of Ross v. State Farm Fire & Casualty, et al., where the New Jersey Appellate Division and Supreme Court ruled that a third-party is not able to proceed directly against an insurer for damages sustained as a result of alleged delays despite the acknowledged obligation to the third-party by the insurer.

In addition to his active practice, Dan is a frequent contributor to various legal journals and a speaker at national asbestos panels. He co-authored a series of articles which discuss many of the issues he has encountered concerning successor liability including the state of the law, intermediary successors, original manufacturer viability, product line continuation and supplier successor liability. 

Prior to joining the firm, Dan was employed by a small insurance defense firm in Maywood, N.J.  While attending law school, Dan was a Judicial Intern for the Honorable James S. Rothschild, J.S.C.
